Terms of Service

1. Introduction

These Terms of Service ("Terms") govern your use of services provided by Clawd AI Enterprise (SSM: 003843011-D), a sole proprietorship registered in Malaysia ("Company", "we", "us").

By subscribing to or using our services, you agree to be bound by these Terms. If you do not agree, do not use our services.

2. Services

Clawd AI Enterprise provides AI-powered automation solutions including but not limited to:

• WhatsApp chatbot development and hosting
• Telegram and Discord bot development
• Website chatbot widgets
• Document AI and tender preparation tools
• AI-powered accounting bots
• Custom AI automation solutions

3. Subscription Plans

Services are offered on a monthly subscription basis. Pricing is as published on our Pricing Page. We reserve the right to modify pricing with 30 days' notice to existing subscribers.

• Subscriptions are billed monthly in advance.
• Setup fees (where applicable) are one-time, non-refundable charges.
• All prices are in Malaysian Ringgit (MYR) unless stated otherwise.
• SST (6%) will be applied where applicable.

4. Payment Terms

• Payment is due upon invoice issuance.
• Accepted methods: bank transfer, credit/debit card (via Fiuu), and e-wallet.
• Late payments may result in service suspension after 7 days overdue.
• Accounts suspended for non-payment will be reactivated within 24 hours of payment receipt.

5. Service Level

• We target 99.5% uptime for all hosted bot services.
• Scheduled maintenance will be communicated 48 hours in advance.
• Support is available via WhatsApp (+60178018359) and email (support@clawdai.my) during business hours (9 AM – 6 PM GMT+8, Monday–Friday).

6. Client Responsibilities

• Provide accurate business information during onboarding.
• Ensure your WhatsApp Business number is active and linked.
• Do not use our bots for illegal, fraudulent, or harmful purposes.
• Do not attempt to reverse-engineer, resell, or redistribute our services.

7. Data & Privacy

Your data is important. Please refer to our Privacy Policy for details on how we collect, use, and protect your information.

8. Intellectual Property

• All bot configurations, custom code, and AI models developed by us remain our intellectual property.
• Client data and business content remain the property of the client.
• Upon termination, client data will be available for export for 30 days.

9. Cancellation & Refunds

• Cancel anytime with 7 days' notice before the next billing cycle.
• No refunds for partial months or setup fees.
• Upon cancellation, bot services will be deactivated at the end of the paid period.
• Data export available for 30 days post-cancellation.

10. Limitation of Liability

To the maximum extent permitted by Malaysian law:

• Our total liability shall not exceed the fees paid by you in the preceding 3 months.
• We are not liable for indirect, consequential, or incidental damages.
• We are not responsible for third-party service outages (WhatsApp, Telegram, payment gateways).

11. Modifications

We may update these Terms from time to time. Material changes will be notified via email at least 14 days before taking effect. Continued use constitutes acceptance.

12. Governing Law

These Terms are governed by the laws of Malaysia. Any disputes shall be resolved in the courts of Labuan, Malaysia.
